COMMUNITYNEW YORK Tuesday, July 16, 1996 2 probation violators to get prison Keller sentenced "like a pack of dogs." The prosecutor said "it shows how depraved and dangerous" Keller is "that when he has it in his mind that someone may be a homosexual, that's good enough reason for him to take another person's life." The fact that Keller was drinking is an aggravating, not mitigating, factor because of Keller's history of drunken violence, Dooley said. Mathews in 1988 sent Keller bation resulting from a youthful offender felony conviction in 1994. New York City authorities reported Andrews was arrested there recently on charges that he possessed a weapon and assaulted someone, said Carol Cocchiola, a senior assistant district attorney. In admitting the probation violation, Andrews denied those allegations, but told Mathews he had resisted arrest. Also before Mathews on Monday: Miquel A.

Delacruz, 25, of the Bronx, was sentenced to one to three years in prison for his April 15 guilty plea to third-degree criminal possession of a controlled substance, a felony. He was accused of having more than an ounce of cocaine when police arrested him Sept. 12 at an apartment at 260 Washington Binghamton, Lehmann said. Juan R. Castro, 26, of Syracuse, was sentenced to six months in jail starting Oct.

21 and probation for five years for his April 19 guilty plea to attempted third-degree criminal sale of a controlled substance, a felony. He sold cocaine to an undercover police agent Nov. 16 in Binghamton, Lehmann said. The judge said he might waive the jail term if Castro does well in a drug treatment program. Jason L.

Criscitello, 20, formerly of 179 Gardner Vestal, was sentenced as a second-felony offender to 18 months to three years in prison for his June 21 guilty plea to attempted fifth-degree criminal possession of a controlled slib-stance, a felony. Criscitello, who had a first-degree burglary conviction Aug. 31 1994, was caught with cocaine April 2 when police answered a disturbance call in Binghamton, Cocchiola said. By KEITH GEORGE Staff Writer Two men who failed to keep out of trouble while on probation will go to prison, a Broome County judge said Monday. James A.

Baines, 25, formerly of Carlisle Apartments, Binghamton, admitted violating terms of probation for an Oct. 27 conviction for fifth-degree criminal possession of a controlled substance, a felony. Broome County Judge Patrick H. Mathews said he will sentence Baines on Aug. 21 to prison for one to three years.

Mary Anne Lehmann, a senior assistant district attorney, said the violation involved a Feb. 8 incident in which Binghamton police caught Baines with cocaine in an apartment at 129 Oak St. David Andrews, 19, of New York City, was sentenced to prison for one to four years for violating pro Press Sun-Bulletin 3B New comp plan defines 'grave' injuries ALBANY (AP) What's the value of a lost finger? Depends on which one. Under New York's new workers' compensation system, the work-related loss of a finger will no longer be considered a "grave" injury, unless it is an employee's index finger. Such were some of the rather fcrisly details that Gov.

George E. Pataki and legislative leaders spent last week haggling about as they made a deal on overhauling New York's workers' compensation system. As part of the reforms, they agreed to limit the filing of third-party lawsuits against employers to those involving only "grave," on-the-job injuries. Adopting that standard entailed defining just what a grave injury means. There was no argument about some injuries: death, an injury causing a person to become a paraplegic or quadriplegic, a severe head injury or the loss of an arm, leg, hand or foot all made the list.

But critics said some other items on the list don't make much sense. "Permanent and severe facial disfigurement" isdefined as a grave injury, as is the loss of an ear or nose. But disfiguring burns below the neck are not. Partial blindness or deafness is not a grave injury, but total blindness or deafness is. Teen injured in Binghamton car-ambulance collision Continued from Page IB murder.

It was not a death penalty case. Murray died in the shallowsof the Chenango River near the Binghamton Plaza just five days before the state's new death penalty law took effect. Walter Hagadorn, 22, formerly of 116 Prospect Binghamton, who led police to the body the next day and who testified against Keller and a third defendant, was sentenced June 28 to 8'i to 25 years in prison for first-degree manslaughter. The evidence indicated that during a beer-drinking session, Keller began advocating that Murray should be killed because he was gay. Chief Assistant District Attorney Kevin P.

Dooley, who called for the maximum sentence, told the judge there was no indication that Murray was met Keller, Jay W. Fink, 30, of Binghamton, and Hagadorn that night when he gave Keller a car ride to get beer. The evidence showed Keller stabbed the victim 25 times with a flat head screwdriver before Murray was dragged, still gasping, into the river. Dooley said the three men, led by Keller, attacked Murray George Hirko of Binghamton Funeral services for George Hirko will be held Wednesday at 9:30 a.m. from the Ernest H.

The judge said he did not believe assertions by Keller and his mother that Keller was innocent.

"I was there, but I didn't kill the man," Keller told the judge. "You are the person who killed him," Mathews replied. "You devised the plan and encouraged younger people to follow and assist you. And with bizarre and baseless motivation, you set out in a cowardly fashion to intentionally and brutally kill a man who had been kind and generous to you."
