Joyce McLean, international coordinator for the environmental group's Great Lakes campaign, said the two climbers had planned to stay atop the Capitol until this morning unless forced down by thunderstorms that threatened the Albany area yesterday. By early last evening, the thunderstorms had appeared and the climbers, who had been an attraction all day to passersby, hauled in their banner and began the slow process of packing up their gear and making the descent. When the pair reached an upper-story section where they could get inside the building, they were taken into custody by Capitol Police.

The two had climbed up the Capitol's south facade under cover of darkness early yesterday morning, said McLean. Through the day yesterday, Hahn's security force never made a move to bring the climbers down forcibly for fear that someone would be injured.

"Right now, we're concerned more about safety than anything else," said the police chief just after the banner was initially unfurled. "I don't want them or any of my men hurt." "Niagara: Still Toxic After All These Years. Why, Gov. Cuomo? Greenpeace," read the 30-by-40 foot white banner that rustled constantly in the swirling wind yesterday. Niagara Falls is the home of the infamous Love Canal chemical dump and numerous other such abandoned hazardous waste sites.

McLean identified the two climbers as Steve Loper, 32, and Richard Harvey, 21, both Greenpeace "action coordinators" from Chicago. She said the two were paid "between $12,000 and $15,000 a year" by Greenpeace and that each had several years climbing experience. country at this time," she said. A local district attorney said he's investigating whether the woman can be charged with a crime. But asked whether he might be able to take action against the woman, Clinton County District Attorney Andrew Ryan said, "It would appear, on first blush, no." Ryan was investigating the case at the request of officials at the base, about 20 miles south of the Canadian border.

Col. Gary L. Hicks, commander of the 380th Combat Support Group, asked for help restraining the woman in a June 18 letter to David Axelrod, commissioner of the state Department of Health, Schottenfeld said. He said the woman was believed to have exposed both civilians and servicemen to the disease without their knowledge. The pay-raise bill was approved by both houses of the state legislature early Saturday morning just hours before members ended the year's regular legislative session.
